●整體敘述 Overall Description
本專題擬介紹美國憲法裁判中的解釋方法及其相關問題。第一部分「導論」（三週）介紹「憲法解釋」所涉及的基本問題。第二部分「憲法（解釋）理論」（二週）探討各種憲法解釋正當化的理論。第三部分「憲法解釋方法」（四週），探討憲法解釋所使用的各種方法。第四部分「案例比較」（三週）分析美國聯邦最高法院、德等聯邦憲法法院等關於特定議題（如同婚、墮胎等）之憲法裁判及其解釋方法。最後（三週）由選課同學綜合學習心得，就我國憲法解釋之方法，提出研究報告。 選課同學應於每週上課前完成當週指定教材之閱讀，並輪流擔任導讀，以利課堂討論；期末時應選定相關議題或大法官解釋，提出符合學術規範之研究報告，交由其他兩位選課同學進行評論，再由全體選課同學評論。報告初稿應經修正，提出學期報告定稿，以供評定成績。
This course introduces students to the theories and practices of
constitutional interpretation from a comparative law perspective. Part One provides,
first, an overview of the primary questions involved in constitutional
interpretation. Part Two reviews the major constitutional theories in the
US. Part Three moves to the legal methods of (or approach to)
constitutional/ statutory interpretation commonly employed in the US courts.
Part Four deals with selected leading cases decided by the ROC Constitutional
Court in comparison with similar decisions in other jurisdictions. Finally,
the last classes will be reserved for students enrolled to present their term
paper and comment on each other’s. |
